| Summary: | The purpose of this research is to determine the form in which, in Venezuela, is regulated and used the technique of removal of the corporate veil to economic groups, to achieve this, the following specific objectives were proposed: 1. Indicate the formation of economic groups and their legal regulation, 2. Explaining the technique of removal of the corporate veil in Venezuela, and 3. Studying legislative and jurisprudential treatment of removal of the corporate veil in the Venezuelan economic groups. Similarly, had the following research questions: 1.) How are corporations defined under Venezuelan law? 2.) What is economic group and what is its regulation in Venezuela? 3.) What constitutes the technique of removal the corporate veil? 4.) Why in Venezuela is possible to remove the corporate veil to economic groups and how it is regulated by the Venezuelan legal system? and 5.) What is the position of the Supreme Court of Venezuela in relation to removal of the corporate veil to economic groups? The methodology was framed within a documentary investigation, supported on a bibliographic design, being therefore the study used of a legal-dogmatic nature. Is obtained as the main conclusion of this study, the true fact that in Venezuela every day judges apply this technique more often in order to penetrate the inner substrate of corporations, in order to determine exactly who are the real culprits in the commission of fraudulent activities, which have, as instrument, to the corporation, applying the technique of removing the corporate veil, in most cases, without an express rules. |
