| Summary: | In our history, since 1.939, the control of prices as an economic governmental technique has been continuously present. Inflation, speculation, hoarding, general welfare are some of the numerous problems that this type of method tries to fix, but as we are going to demonstrate, the tradicional answer that has been given, only increases those problems, and brings, in addition, shortage, unemployment and economic slowdown. Moreover, even when the Venezuelan Constitution of 1.999 sets the ground for an economy based on planning, it also established a system of human rigths protection, which includes economic rights and civil liberties; the State has the obligation to protect, guarantee and secure all of them, so, it has to find armony between the protection of those rights (which is its main and fundamental goal) and the planning referred in the Constitution. The Costs and Prices Fair Act passed in 2.011 and its reforms, provides a system in which the price is set by a governamental authority and not by the market. In this paper, we are going to describe the consecuences of that type of system, the role of the prices in the market and its importance for a healthy economy. Also, we are going to discusse the constitutionality of that Act and the impact that it has on the economic rights. |
